Welcome to brand-launch.com (the "Website"), operated by Brand Launch ("Brand Launch," "we," or "us"). These Terms of Service (the "Terms") govern your access to and use of the Website, including any content, features, and resources available through it. By accessing or using the Website, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Website.
The Website and the Services are offered only to businesses and individuals located in the United States, and we accept payment only from United States sources.
Note for clients. If you become a client through a paid engagement, your relationship with us is separately governed by your signed service agreement, any production or on-camera release, and any applicable addenda or policies. If those documents conflict with these Terms, the client documents control for that engagement.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live if that is higher, to use the Website. By using the Website, you confirm that you meet this requirement and that you are located in the United States.
2. Your account
If you create an account with us or through a connected platform, you are responsible for keeping your login details confidential and for all activity under your account. Tell us right away at privacy@brand-launch.com if you believe your account has been accessed without your permission.
3. Intellectual property
All content on the Website, including text, graphics, logos, images, video, frameworks, software, and the Brand Launch name and brand, belongs to Brand Launch or its licensors and is protected by United States intellectual property laws. You may not copy, distribute, modify, publicly display or perform, or create derivative works from our content without our prior written permission.
Client work and licenses are governed by your service agreement, not by this Section.
4. Acceptable use
You agree to use the Website only for lawful purposes. You may not:
- Use the Website in a way that breaks any law or regulation;
- Try to gain unauthorized access to the Website or its systems;
- Introduce malware, viruses, or other harmful code;
- Harass, impersonate, or harm others;
- Scrape, data-mine, or use automated tools to collect content from the Website, except as we permit in writing.
We may suspend or end your access for any violation of these Terms.
5. Third-party services and links
The Website may link to third-party sites and may use third-party services (for example, our payment processor and our form and booking provider). Those services have their own terms and privacy policies. We are not responsible for the content, practices, or availability of third-party services.

8. Recordings, testimonials, and likeness
We film original content at client locations and may record calls and meetings, in each case with appropriate notice and consent. How we may use a client's name, likeness, footage, testimonials, and results for marketing is governed by the client's service agreement and production or on-camera release, which control over this Section. Any testimonials we publish will be truthful and compliant with FTC guidelines. If you prefer not to be featured in marketing, tell us and we will discuss options before or at the start of your engagement.
9. Disclaimer of warranties
THE WEBSITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BRAND LAUNCH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE, INCLUDING LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, WHATEVER THE THEORY OF LIABILITY. OUR TOTAL LIABILITY ARISING FROM OR RELATING TO YOUR USE OF THE WEBSITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100 USD). FOR CLIENTS, THE LIMITATION OF LIABILITY IN THE SERVICE AGREEMENT CONTROLS.
11. Governing law and venue
These Terms, and any dispute arising from or relating to your use of the Website, are governed by the laws of the State of California, without regard to conflict-of-law rules. Any such dispute may be brought only in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts. Clients are subject to the dispute-resolution terms of their service agreement, which control over this Section.
12. Time limit on claims
Any claim arising from or relating to your use of the Website must be brought within one year after the claim first arises, or it is permanently waived to the fullest extent permitted by law.
13. Force majeure
We are not liable for any failure or delay in operating the Website caused by events beyond our reasonable control, including natural disasters, cyberattacks, pandemics, government action, or third-party platform outages.
14. Severability
If any part of these Terms is found invalid or unenforceable, that part will be modified to the least extent needed to be enforceable, or removed if that is not possible, and the rest of the Terms will stay in effect.
15. No waiver
If we do not enforce a provision of these Terms, that is not a waiver of the provision or of our right to enforce it later.
16. Changes to these Terms
We may update these Terms from time to time. We will post the updated version and change the date above. Continuing to use the Website after changes are posted means you accept them.
